Farmers and advocates are taking a stand against the state's water rights lawsuit in the Nooksack Basin, aiming to file a motion to dismiss the adjudication if granted permission by the Whatcom County Superior Court. The Ag Water Board of Whatcom County, representing agricultural interests in the Nooksack watershed, believes the adjudication would severely impact the local agricultural community. The board, alongside a group of farmers, recently requested the court's approval to file three motions, despite a stay on most motions related to the adjudication.
One of the motions seeks to dismiss the lawsuit on the grounds that it lacks necessary parties, specifically Canadian water users whose rights are subject to a U.S.-Canadian Treaty. Another motion aims to establish a uniform deadline for all water users to file claim forms. While most water users affected by the lawsuit have a May 1 deadline, some have a yet-to-be-determined deadline in 2027, as they were not served their summons by certified mail. According to state law, these users can also be informed by publication in a newspaper, and those in the Nooksack Basin region have at least one year after receiving their summons to file a claim.
The water board's concerns extend to the difficulty of communicating filing deadlines when some users haven't been served yet. Additionally, the board is seeking to classify the issues over the inclusion of water users as 'Issues of Broad Legal Importance,' which would result in a briefing schedule to resolve these issues over the next few months. This proactive approach aims to limit unnecessary costs and ensure fairness in the adjudication process. The state Department of Ecology, which filed the lawsuit, was not available for comment on the matter.
